Twenty-six lawyers from Missouri’s two leading law firms in affordable housing development sent formal comments to the Missouri Housing Development Commission (MHDC) on December 4, 2017. They found the proposal sponsored by the Governor to completely omit Missouri Low Income Housing Tax Credits from the State’s annual qualified allocation plan to be contrary to established law. 

The attorneys cited Missouri statutes which require the Commission to establish criteria for issuing the state housing credits and then consider each project on an individual needs basis to ensure financial feasibility. The Governor’s proposal ignores these legal requirements and intentionally prohibits affordable housing projects from even applying for state credits. The attorneys urged the Commission to reconsider their proposal.
